FOI SERVICES PRIVACY NOTICE

 The SLSU FOI Services is created in compliance with E.O. No. 2, series of 2016, and is responsible in operationalizing the citizen’s constitutional right to information. The Office is committed to safeguard the data or information collected and acquired by Southern Leyte State University in strict compliance with R.A. 10173, otherwise known as “The Data Privacy Act of 2012,” its Implementing Rules and Regulations and regulatory issuances of the National Privacy Commission, and ensure that the principles of transparency, legitimate purpose, and proportionality are observed with all sobriety and diligence in the processing of collected and acquired data or information in relation to FOI request.

This Privacy Notice outlines the reason why the office collects and acquires data or information, the kinds and forms of data or information, how the data or information are utilized, shared, disclosed, stored, retained and protected, the data subject’s rights and the contact details in cases when there are questions, comments, requests and concerns regarding the collected and acquired data or information.

• Data or Information Collected and Acquired

The SLSU FOI Services collects and acquires the personal information of the requesting party such as name, complete address, mobile number, email address and a photocopy of one government issued ID to establish identity during the filing of application for FOI request.

• Data or Information Utilization

Once deemed valid, your information from your application will be used solely by the SLSU FOI Services to deal with your application as set out in the Freedom of Information Executive Order No. 2 series of 2016 and its institutional policy and mechanisms. If the University gives you access to a document or information, the document or information will be published online in the SLSU FOI Services’ disclosure log, along with your name and the date you applied. Furthermore, the data or information collected and acquired will also be used in producing required FOI reports as part of the office’s reportorial responsibility to the Presidential Communications Operations Office (PCOO) as the regulatory body.

• Data or Information Sharing and Disclosure

As a general rule, the SLSU FOI Services does not share the collected and acquired data or information to third-party entities without the Data Subject’s consent. However, the office may share the collected and acquired data or information for specific purposes as required and provided by or in compliance with applicable laws.

• Data or Information Storing, Retention and Protection

To ensure the responsive safekeeping of the collected and acquired data or information and to prevent the same from loss, misuse, unauthorized modification, unauthorized or accidental access or disclosure, deletion, alteration or destruction, the SLSU FOI Services instituted the following measures: (a) provision of secure office for data collection, use and storage, and (b) access to data or information is only limited to the designated Head of FOI Services and the FOI Receiving Officer in the performance of their duties, functions and responsibilities, and upon legitimate interest. Retention of collected and acquired data or information shall be based on absolute necessity and specific purposes.

• Data Subject Rights

The SLSU FOI Services imposes itself paramount respect and acknowledgment on the privacy of the Data Subjects and strives to uphold the rights of the same as guaranteed by R.A. 10173, to wit: (1) right to be informed, (2) right to object, (3) right to access, (4) right to rectify or correct erroneous data, (5) right to erase or block, (6) right to secure data portability, (7) right to indemnified for damages, and (8) right to file a complaint.
